Scott Lepak Named to the Public Employment Relations Board

Barna, Guzy & Steffen, Ltd. is pleased to announce that Governor Walz has appointed shareholder Scott Lepak to serve on the Public Employment Relations Board (PERB). Scott will serve as the alternate public employer’s representative. The Board is the body charged with addressing unfair labor practice charges under the public sector labor relations law. This Board was originally active from 1971 to 1991 and was recreated in 2014.  Scott is a shareholder in our labor and employment section. He has been working in this area for well over 30 years. Scott noted that he appeared before this Board as an advocate during its original mission. He is delighted to now serve in this new capacity. He also pointed out, in response to numerous questions from public employer clients, that he will continue to represent public sector employer and municipal clients.  “This is very much a less than part time gig,” Scott said. “We needed another representative to get cases processed when the regular public sector board member had a conflict or was unavailable. Litigation and Dispute Resolution During a Pandemic

Intelligence is the ability to adapt to change.  – Stephen Hawking My, how things have changed in less than a year. Our court systems and law firms were humming along mediating, litigating, arbitrating, and getting those business and personal disputes settled or resolved in what we refer to as “the normal course of business.” Most, if not all of us, never thought even a year ago, that the way we did business – the business of lawyers and law firms – would have to be completely reimagined to survive and keep dispute resolution moving forward. Read on as we discuss litigation and dispute resolution during a pandemic. Not Exactly Business as Usual Legal disputes did not stop with COVID-19. In fact, it created even more issues to be resolved among businesses, individuals, and insurance companies. It even created new banking, contract, insurance, and employment issues that needed immediate attention. But the more common disputes like breach of contract, warranty cases, real estate disputes, and construction defect cases did not slow down.
